With the family tree and case study of the fictional Smith family in hand, we invite you to follow a Will challenge from the first client meeting until the final resolution.
 
Experienced faculty will guide you through the facts from the perspective of the applicants challenging the Will as well as the responding parties. They will discuss the decisions that need to be made along the way and the pleadings that come out. Sample pleadings will be shared with you.

Fundamental topics will include:
  • Initial interviews and file organization
  • Scope of the claim
  • Pre-trial and case management
  • Expert, hearsay and lay evidence
  • Cross-examination and discovery
  • Lawyer files and privilege
  • JADR and mediation
  • Hybrid trials

This course is designed for lawyers new to the practice of wills and estates litigation, as well as those looking to brush up on the basics.
