This course covers substantive information about the Family Homes on Reserves and Matrimonial Interests or Rights Act (FHRMIRA), and practical information to know when making applications under the Act. It is relevant for lawyers practicing in the areas of family, wills and estates, aboriginal, and criminal law.
Please note that since the creation of this course, the legislation has been amended:
by the Budget Implementation Act, 2019, No. 1 – 2019, c. 29 and the Fall Economic Statement Implementation Act, 2022 (S.C. 2022, c. 19).
The definition of interest or right, which appears in Part 2 of the course has been revised and can be found at https://laws-lois.justice.gc.ca/eng/acts/F-1.2/page-1.html#h-220946
Also note that a Self-government agreement was signed by MMF in 2024 making them the government for Manitoba Metis. It does not include matrimonial property rights, which may be negotiated separately in future.
