The Western Law Societies Conveyancing Protocol was jointly developed by the law societies of Manitoba, Alberta, British Columbia, and Saskatchewan. It sets out enhanced standards of conveyancing practice, with the goal of providing excellent client service in residential sale, purchase, and mortgage transactions.
The Protocol was created in 2001, updated in 2009, and is tailored for use in Manitoba.
CAUTION: The trust condition provisions of the Protocol (comprised of sections 7.1 and 7.2 of Part D, sections 8.1 and 8.2 of Part E, the Memorandum of Trust Conditions in Schedule II, and the Sample Trust Conditions in Schedule III) were last amended in March, 2009. They have not been updated to reflect more recent changes in conveyancing law and practice, including the November 1, 2025 changes to the statutory offer to purchase forms. It remains the lawyer’s responsibility to ensure that trust conditions are customized to meet current conveyancing laws and practice standards.
The Standard Conveyancing Practice (“SCP”) trust conditions [Conveyancing Practices Working Group, version 2025.1] have been approved by the Law Society of Manitoba for use on Protocol closings.
